In 2014, Sir James Munby said
of the Deprivation of Liberty’s that the number of disabled people being
deprived of their liberty was “vastly greater” than previously assumed. Sir James, went on to clarify that there was
likely to be a “very significant” increase in the number of “deprivation of
liberty'' cases Court of Protection judges would be asked to analyse and
monitor. This will have financial implication
for Local authorities with responsibilities for the care of disabled people.
The Court of Protection is
where issues relating to people who lack the mental capacity to make decisions
are considered, in some circumstances due to lack of understanding and
knowledge of the Mental Capacity Act 2005 a large percentage of people are “legally
deprived of liberty”.
The Edith Ellen Foundation,
